CONSERVATION
AREA

​​​​Most garden rooms will come under what is known as “Permitted Development” which means that no planning permission is required. Whether you will need to make a planning application very much depends on where you live, what you are planning to use the room for, its size and roof shape and how close it is situated to the boundaries of your property.

 

If the Studio has an internal floor area of between 15 and 30 square meters, then it will be built at least one meter away from any boundary wall.  If you wish to build less than one meter from your boundary and your internal floor area is greater than 15m2, then some form of fire resistant material will need to be incorporated into the build.

The conditions for Permitted Development are as follows:

​

  • ​​Rooms have a maximum external height of 2.5m

  • ​​No studio shall be built in front of the main house

  • ​Any decking shall not exceed 300mm or 0.3m in height

  • No more than half the area of land around the "original house" would be covered by additions or other buildings

  • ​Within the curtilage of “listed” buildings, any outbuilding will require planning permission

  • ​On designated land, buildings and enclosures at the side of properties will require planning permission

  • ​​No garden room or outbuilding shall be constructed as a separate self-contained living accommodation.

  • ​A dual-pitched roof garden room should be no higher than 2.5 metres at the eaves and no taller than 4 metres at the ridge. Garden rooms with this shape roof need to be sited more than 2 metres from each boundary​.

If you are intending to use your garden room as a commercial space then planning permission will always be required. As previously stated your garden room cannot be used
as living accommodation, without approval.

Building regulations will not normally be required for garden rooms with less than 15 square meters internal floor area and that are not set up as living/sleeping accommodations. This size and type of garden room may be built as close as possible to your boundary wall.


If the building is between 15 and 30 square meters, contains no sleeping accommodation and is built at least one meter away from the boundary wall then building control and planning permission is not normally required.​​

If your property is situated within a Conservation Area we recommend that the customer makes enquires through their local planning dept to confirm whether or not any Article 4 Directives have been applied to your property.

​

Article 4 will state if there are any restrictions on your permitted development rights. It is
the Customers responsibility to contact their local authority to ascertain if any Permitted Development Rightrestrictions have been placed on their property (Article 4 Directive)

​

If you live within a conservation area and you wish to remove a tree to facilitate your garden room build you will need to look into what is known as a T.P.O (Tree preservation order). Concerning this, your local athority will be able to advise you on how to best move forward.
